They further sought a declaration that the PDP acted negligently and in bad faith by assigning the Sokoto governor’s votes to Atiku at the primary. The fourth ground was that the instant suit was not initiated by due process of the law and therefore sought order of the court striking out or dismissing the suit in its entirety for want of jurisdiction. Atiku PDP and Tambuwal further stated that the suit as brought by the applicants did not fall within the purview of Section 84 of the Electoral Act, as such did not qualify as a pre-election dispute.

Although Governor Wike had, recently, denied filing any suit against the party and its presidential candidate, the party and others were represented in court, except INEC’s counsel, who was not on court. Prince Michael Ekamon and Mr Wike are 1st and 2nd plaintiffs respectively in the suit marked: FHC/ABJ/CS/782/2022 dated and filed on June 3. 14 to hear a suit filed by Governor Nyesom Wike of Rivers against the Peoples Democratic Party, PDP, and its Presidential Candidate, Atiku Abubakar.
