The Bar Council and Law Society recently commissioned an independent report on the subject, which recommended a non-binding guidelines system in preference to a mandatory scale of legal costs. These reforms will require a combination of legislation, amendments of the Rules of Court, operational improvements and simplified court forms and procedures to be implemented. It was the culmination of the work of a review group chaired by the former President of the High Court, Mr Justice Peter Kelly (Group), tasked with reviewing and reforming the administration of civil justice in Ireland. The Report made over 90 recommendations (Recommendations) for reform, including to court procedures and practices.

The magistrate judge has scheduled a video hearing Thursday on Witsell’s request to keep the OPR report under wraps. The Justice Department, which is representing all other federal agents named in the lawsuit, is refusing to defend Witsell in the case. “On June 30, DHS-OPR finalized its report and declined to refer the matter for agency action against Agent Witsell.” It’s not known when Steger will rule on a request by Witsell and his fellow agents to keep the video footage under seal. Witsell is asking U.S. Magistrate Judge Christopher Steger to permanently seal those records and the video, but Steger has not yet issued a ruling. Within days, the division stated in a letter that it would not conduct a formal inquiry, according to court records.

Prosecution or compensation? What Kenyan choices tell us about ... (The Conversation CA)

Research in Kenya finds victims or witnesses to violence are less likely to buy into anti-International Criminal Court political narratives.

This is because these are the people they turn to for material and other support. Individuals who have encountered violence are more likely to prioritise “righting the wrong” even if it means their co-ethnics will be punished. Our study additionally collected data on ethnicity and on whether the respondent was exposed to post-election violence as a witness or victim. Many have criticised the court for, among other reasons, its paucity of convictions. Third, and perhaps most importantly, Kenyans who self-identified as witnesses or victims of violence generally preferred prosecutions over compensation. When denied justice locally, they may be willing to support the court’s quest to deliver justice and accountability. Our research team carried out face-to-face surveys of more than 500 Kenyans in five regions in the country where violence had occurred. Citizens may prefer both, but we phrased the question this way because in post-conflict situations, countries don’t always have the resources to pursue every available justice mechanism. They called the ICC an imperialistic institution that is biased against Africans. In 2010, the International Criminal Court (ICC) charged six prominent Kenyans with inciting the violence. The government also failed to protect witnesses. In December 2007, the Electoral Commission of Kenya announced that Mwai Kibaki had won a second five-year term as president.
